Host Terms

These Host Terms apply to property owners, managers and other authorized persons who create, manage or publish BnB listings through PataStay.

Important for every host

By registering as a host, listing a property or purchasing a host package, you agree to these Host Terms together with PataStay's Terms and Conditions and applicable policies.

Introduction

These Host Terms govern the use of PataStay by property owners, property managers and other authorized persons who register as hosts or submit accommodation listings to the platform.

These Host Terms should be read together with PataStay's Terms and Conditions , Privacy Policy, Acceptable Use Policy and other applicable policies.

By registering as a host, submitting a property or purchasing a host package, you confirm that you have read and accepted these Host Terms.

PataStay is a connection platform

PataStay helps guests discover BnBs and connect with independent hosts. The host remains responsible for the property, accommodation arrangements and information provided to guests.

Host Eligibility

A person registering as a PataStay host must have the legal capacity and authority necessary to manage or offer the relevant accommodation.

Hosts are responsible for ensuring that their use of PataStay and operation of their accommodation complies with applicable laws, regulations, licensing obligations and property requirements.

You must not register as a host using:

  • False or misleading personal information.
  • Another person's identity without authorization.
  • False business information.
  • Information designed to conceal the true operator of a property.

Authority to List a Property

You may only list a property where you have the legal right, permission or authority to advertise or manage that accommodation.

This may include acting as:

  • The property owner.
  • An authorized property manager.
  • An authorized agent.
  • A person otherwise legally entitled to offer the accommodation.

You must not list another person's property without permission.

Unauthorized listings may be removed

PataStay may request evidence of ownership, management authority or permission where reasonably necessary.

Host Account Responsibilities

Hosts are responsible for keeping their PataStay account information accurate and current.

You are responsible for maintaining the confidentiality of your login details and for activity performed through your account.

You should promptly update information including:

  • Host name.
  • Email address.
  • Telephone number.
  • WhatsApp number.
  • Property details.
  • Payment or business information where applicable.

Notify PataStay promptly if you believe your host account has been accessed without authorization.

Property Listings

Hosts are responsible for ensuring that every listing they publish or submit accurately represents the relevant property.

Listing information should be sufficiently clear to allow guests to understand what type of accommodation is being offered.

Listing information may include:

  • Property name.
  • General location.
  • Accommodation type.
  • Property description.
  • Photographs.
  • Amenities.
  • House rules.
  • Occupancy limits.
  • Approximate accommodation price.
  • Availability information.

Hosts must promptly update or correct materially inaccurate information.

Listing Content and Photographs

Content submitted by a host must relate to the property being listed and must not intentionally mislead guests.

Photographs should reasonably represent the property, rooms, facilities or amenities being advertised.

Hosts must not upload:

  • Photographs of unrelated properties.
  • Content copied unlawfully from another host or website.
  • False or fabricated property information.
  • Images designed to misrepresent the actual property.
  • Unlawful, abusive or inappropriate content.

By submitting content to PataStay, the host confirms that they have the right to use and publish that content.

Property Availability

Hosts are responsible for communicating current property availability to guests.

Where PataStay provides availability tools or property status controls, hosts should keep those details reasonably current.

If a property becomes occupied or temporarily unavailable, hosts should update the relevant status where that functionality is available.

A listing is not a guaranteed reservation

Guests are instructed to confirm availability directly with the host after unlocking contact details.

Accommodation Pricing

Hosts are responsible for determining their own accommodation prices unless otherwise agreed with PataStay.

Any price displayed on a listing should be reasonably accurate and should not intentionally mislead guests.

Before accepting accommodation payment, hosts should clearly communicate:

  • The accommodation price.
  • The period covered by the payment.
  • Any deposit required.
  • Any additional charges.
  • Any applicable cancellation terms.

Hosts should not advertise one price solely to attract guests and then demand a materially different price without a legitimate reason.

PataStay Host Packages and Subscriptions

PataStay may offer free or paid host packages with different listing limits, durations, features or benefits.

The features attached to a package are those shown at the time the host selects or purchases the package, subject to these Host Terms.

Depending on the package, features may include:

  • A specified number of property listings.
  • Listing visibility.
  • Host dashboard access.
  • Guest unlock notifications.
  • Guest messaging functionality.
  • Other platform features introduced by PataStay.

A host should review package details before making payment.

Host Package Payments, Renewals and Upgrades

Where a host purchases a paid PataStay package, the applicable package fee must be paid using the payment methods made available by PataStay.

Package activation may depend on successful payment confirmation or administrative approval where manual payment methods are used.

Hosts may be able to renew, resubscribe or upgrade their package subject to the package options available at that time.

Expired packages may lose access to features associated with the previous paid package.

Package fees and guest accommodation payments are different

Host package fees are paid to PataStay for platform services. Accommodation payments from guests are generally paid directly to the host.

Guest Unlocks and Enquiries

Guests may pay PataStay an access fee to unlock available host contact details associated with a property.

A successful unlock may give the guest access to communication options such as:

Guest may contact the host using the unlocked phone number.

02 WhatsApp

Guest may contact the host using an available WhatsApp option.

03 PataStay Chat

Guest may send messages directly to the host dashboard.

04 Direct Arrangement

Guest and host confirm the accommodation details together.

The host should respond to legitimate guest enquiries accurately and professionally.

Messages and Communication

PataStay may provide an on-platform messaging feature through which unlocked guests can communicate with hosts.

Messages sent through PataStay may appear inside the host dashboard and hosts may receive notifications regarding unread guest messages.

Hosts must not use communication tools to:

  • Harass or threaten guests.
  • Send abusive or discriminatory messages.
  • Request passwords, PINs or banking credentials.
  • Send unrelated advertising or spam.
  • Attempt to deceive or defraud guests.

PataStay may retain and review on-platform messages where reasonably necessary for support, platform safety, dispute investigation or abuse prevention.

Accommodation Arrangements With Guests

An unlock does not itself create an accommodation reservation. The host and guest must communicate directly and agree on the details of the stay.

Hosts should clearly confirm:

  • Property availability.
  • Guest arrival date.
  • Departure date.
  • Number of guests.
  • Accommodation price.
  • Payment requirements.
  • Check-in instructions.
  • House rules.
  • Any deposit or additional charge.

Hosts should avoid accepting accommodation payment where the property is not available for the agreed stay.

Accommodation Payments From Guests

Unless PataStay expressly states otherwise for a particular service, accommodation payments are made directly between the guest and host.

Hosts are responsible for providing accurate payment instructions.

The host should communicate the name or business receiving the payment and the amount required before asking the guest to pay.

Hosts must not deliberately use misleading payment information or request payment for accommodation they do not intend or are unable to provide.

Property Safety and Host Responsibilities

Hosts are responsible for maintaining their accommodation in a reasonably safe and lawful condition.

Hosts should take reasonable steps appropriate to their property to address matters such as:

  • Door and access security.
  • Electrical hazards.
  • Gas or cooking hazards.
  • Unsafe structural conditions.
  • Emergency exits where applicable.
  • Water or sanitation problems.
  • Other hazards reasonably known to the host.

Hosts should disclose important property conditions that could materially affect a guest's decision to stay.

Host Conduct

Hosts must treat guests fairly, professionally and respectfully.

A host must not:

  • Threaten, harass or intimidate guests.
  • Discriminate unlawfully.
  • Misrepresent the identity of the host or property.
  • Use PataStay for unlawful activity.
  • Attempt to compromise PataStay systems or accounts.
  • Misuse guest personal information.
  • Request sensitive credentials from guests.
  • Publish knowingly misleading listing information.

Hosts must also comply with the Acceptable Use Policy .

Host Cancellations and Changes

Where a host has confirmed accommodation with a guest, the host should make reasonable efforts to honor the agreed arrangement.

If a host can no longer provide the accommodation, the host should notify the guest as soon as reasonably possible.

Any accommodation refund due following a host cancellation is generally a matter between the host and guest where the accommodation payment was made directly to the host.

Repeated host cancellations or repeated complaints may result in listing review or account restrictions.

Complaints and Disputes

PataStay may receive complaints from guests regarding property descriptions, availability, payment requests, communication, safety or host conduct.

Where reasonably necessary, PataStay may request information from the host including:

  • Messages exchanged with a guest.
  • Property information.
  • Payment information.
  • Photographs.
  • Evidence of ownership or management authority.
  • Other information relevant to a reported concern.

Hosts are expected to cooperate reasonably with legitimate platform investigations.

Platform Monitoring and Review

PataStay may monitor platform activity where reasonably necessary to protect users and maintain platform integrity.

This may include reviewing:

  • Host account activity.
  • Property submissions.
  • Guest unlock activity.
  • On-platform messages.
  • Payment records relating to PataStay services.
  • User reports and complaints.

Administrative review of a conversation does not necessarily mean PataStay is a party to the accommodation arrangement.

Listing Suspension, Account Restriction and Removal

PataStay may restrict, suspend or remove a property listing or host account where reasonably necessary.

Reasons may include:

  • Suspected fraud.
  • False property information.
  • Unauthorized property listings.
  • Repeated serious guest complaints.
  • Safety concerns.
  • Abusive or threatening behaviour.
  • Payment abuse.
  • Violation of these Host Terms.
  • Violation of another applicable PataStay policy.

PataStay may request clarification or supporting information before restoring a restricted account or listing.

Host Responsibility and Liability

Hosts remain responsible for the operation of their properties and for accommodation arrangements they enter into with guests.

The host is responsible for representations made regarding the property, availability, pricing, payment instructions and conditions of stay.

To the extent permitted by applicable law, PataStay is not responsible for obligations arising solely from an accommodation agreement between an independent host and guest where PataStay is not the accommodation provider.

Nothing in these Host Terms excludes responsibility that cannot legally be excluded.

Guest Privacy and Personal Information

Hosts may receive guest information where reasonably necessary for accommodation enquiries or communication.

Hosts must use guest information only for legitimate purposes connected with the accommodation enquiry or stay unless another lawful basis applies.

Hosts must not:

  • Sell guest contact details.
  • Publish guest personal information without lawful justification.
  • Use guest details for unrelated spam.
  • Share sensitive information unnecessarily.

PataStay's handling of personal information is described in the Privacy Policy .

Changes to These Host Terms

PataStay may update these Host Terms to reflect changes to host services, platform functionality, package structures, legal requirements or operational practices.

Updated Host Terms will be published on this page with the applicable revision date.

Continued use of host services after updated terms become effective may constitute acceptance of the revised terms where permitted by law.

Governing Law

These Host Terms are governed by and interpreted in accordance with the applicable laws of Kenya.

Where a dispute cannot reasonably be resolved, it may be referred to an appropriate court or competent dispute-resolution forum in accordance with applicable law.

Hosts may contact PataStay regarding account issues, package questions, property listings, guest reports or these Host Terms.
